Ohio Line Fence Law and Upcoming Affidavit Deadline
Many landowners and farmers about the upcoming September 30 deadline for filing an “Affidavit of Preexisting Line Fence.” Below are a few resources that should help you with these questions:
- An OSU fact sheet explaining the affidavit procedure. This addresses many of the questions you’re receiving, such as “does my wife need to sign the affidavit?” and “where do I file the form?” Factsheet available here: Affidavits_for_New_Line_Fence_Law
- A model affidavit for “preexisting fences” developed by the Ohio Farm Bureau. Note that this is a “model” and that we at OSU cannot endorse the form, help landowners complete or file the form, or in any way suggest that we are offering legal advice by providing the form. We may simply provide the form and suggest that the landowners consult with an attorney to complete the affidavit. Ohio Farm Bureau example affidavit
